    This Privacy Notice explains how Talentelly ("we", "us", or "our") collects, uses, stores, and protects personal data when you use our websites, applications, and related services (collectively, the "Services"). We are committed to handling personal data in line with the Digital Personal Data Protection Act, 2023 (India) ("DPDP Act") and applicable rules.

    By using the Services or otherwise providing personal data to us, you acknowledge this Notice. Where the DPDP Act requires consent, we will obtain it separately (for example, at registration). If you do not agree with this Notice, please do not use the Services.

    1. Who this Notice applies to

    This Notice applies to individuals who interact with our Services, including registered users, organization representatives, and visitors who submit information through our contact or signup flows ("you" or "Data Principals" under the DPDP Act).

    2. Personal data we collect

    Depending on how you use the Services, we may collect categories of personal data such as:

    • Identity and profile: name (first and last), username or display name, date of birth, gender or similar demographic fields where you choose to provide them, photograph or avatar if you upload one.
    • Contact and account: email address, phone number, organization name and address details where relevant, and credentials used to secure your account.
    • Talent and activity data: information you or your organization enter in connection with talent management—such as teams, rosters, performance or participation records, schedules, certificates, and communications sent through the platform.
    • Technical and usage data: device type, browser, IP address, approximate location derived from IP, log and diagnostic data, cookies or similar technologies where used, and analytics events needed to operate and secure the Services.
    • Support and correspondence: content of messages you send to us (for example via hello@talentelly.com).

    We collect personal data that you provide directly, that your organization provides on your behalf where permitted, and limited data collected automatically when you use the Services.

    3. Purposes and lawful bases

    We use personal data only for specific, legitimate purposes, including:

    • Providing, operating, and improving the Services, including talent management features you or your entity use.
    • Creating and maintaining accounts, authentication, security monitoring, and fraud prevention.
    • Communicating with you about the Services, service-related notices, and (where permitted) product updates.
    • Complying with law, responding to lawful requests from public authorities, and enforcing our terms.
    • Resolving disputes and exercising or defending legal claims.

    Where the DPDP Act requires consent, we rely on your freely given, specific, informed, and unambiguous consent for processing that is not otherwise permitted under applicable law. You may withdraw consent in line with Section 7 below, subject to legal or contractual restrictions.

    4. No sale of personal data; limited sharing

    We do not sell your personal data. We do not disclose personal data to third parties for their independent marketing. We share personal data only where necessary and appropriate:

    • With service providers and subprocessors who assist us (for example hosting, email delivery, analytics, or customer support) under written terms that require protection of personal data and use limited to our instructions.
    • With your organization or entity administrators where the Services are used in an organizational context and such sharing is part of providing the product you use.
    • When required by law, court order, or government request, or to protect the rights, safety, and security of users, the public, or Talentelly.
    • In connection with a merger, acquisition, or asset transfer, subject to confidentiality and continuity safeguards.

    5. Storage, cross-border transfers, and security

    Personal data may be stored or processed using infrastructure or subprocessors located in India and, where applicable, in other jurisdictions. Where personal data is transferred outside India, we take steps consistent with the DPDP Act and applicable directions of the Data Protection Board of India, including appropriate contractual and organizational safeguards.

    We implement technical and organizational measures designed to protect personal data against unauthorized access, alteration, disclosure, or destruction. No method of transmission over the Internet is completely secure; we encourage you to use strong passwords and protect your credentials.

    6. Retention

    We retain personal data only for as long as necessary to fulfil the purposes described in this Notice, unless a longer period is required or permitted by law. Retention periods may depend on the nature of the data, legal obligations, dispute resolution, and legitimate business needs (for example backups with controlled lifecycles). When retention ends, we delete or anonymize personal data where feasible.

    7. Your rights (Data Principals)

    Subject to the DPDP Act and applicable rules, you may have the right to:

    • Obtain confirmation of processing and access a summary of personal data we hold about you where required.
    • Request correction of inaccurate or incomplete personal data.
    • Request erasure of personal data where applicable law permits.
    • Withdraw consent where processing is based on consent, without affecting the lawfulness of prior processing.
    • Nominate another individual to exercise certain rights on your behalf in case of death or incapacity, as prescribed.
    • Grievance redressal and the right to approach the Data Protection Board of India in accordance with law.

    To exercise these rights, contact us at hello@talentelly.com. We may need to verify your identity before responding. We will address grievances within timelines prescribed under the DPDP Act once applicable rules specify them; until then, we aim to respond within a reasonable period, typically thirty (30) days.

    8. Grievance officer

    For any questions, concerns, or complaints regarding the processing of your personal data, you may contact our Grievance Officer at hello@talentelly.com. Please include a clear description of your concern and your account or contact details so we can assist you efficiently.

    9. Children

    The Services are not directed to children below the age at which valid consent can be given under applicable law without parental authorization. If you believe we have collected personal data from a child without appropriate consent, please contact us and we will take appropriate steps.

    10. Cookies and similar technologies

    We may use cookies and similar technologies for essential operation of the Services, security, preferences, and limited analytics. You can control certain cookies through your browser settings. Essential cookies may be required for core functionality.

    11. Automated processing

    We do not use solely automated decision-making that produces legal or similarly significant effects concerning you, unless we expressly inform you otherwise and comply with applicable requirements.

    12. Changes to this Notice

    We may update this Privacy Notice from time to time. We will post the updated version on this page and revise the "Last updated" date. Where changes materially affect your rights, we will provide additional notice as required by law (for example, through the Services or email).
